ONLINE AUCTION TERMS & CONDITIONS

AUCTION CLOSES PROMPTLY AT 9 P.M. EST on tuesday, November 16, 2021.

By bidding in our online auction, each bidder agrees to the following:

  1. All sales are final. Michael Garron Hospital Foundation has attempted to describe all items as accurately as possible, but in no event shall be held responsible for the correctness of descriptions, provenance or condition of the items. All items are sold ‘as is’.
  2. No statements contained in the online auction description shall be deemed a warranty, representation or assumption of liability. Items depicted are for illustrative purposes only and may not be exactly as shown.
  3. Michael Garron Hospital Foundation will not be responsible for refunds for items that the purchaser is unable to use due to ongoing COVID-19 restrictions, or companies that close for business.
  4. In accordance with Canadian Revenue Agency guidelines, items purchased in an auction are only qualified for a tax receipt when the purchase price exceeds the item’s retail price by 25% or more. The purchaser can receive a tax receipt for the portion of the auction purchase price exceeding the item’s fair value. Items deemed priceless (whose value cannot be determined) are not eligible for tax receipts.
  5. Any bidder making a bid for an item acknowledges and agrees that their offer is an irrevocable offer to complete the transaction if they are the winning bidder.
  6. Reservations and arrangements for trips, packages and services are the responsibility of the purchaser and must be arranged with the donor(s) by the purchaser. Some items have restrictions and/or expiry dates. All items or services must be used within the time limit specified and according to the donor’s restrictions.
  7. Due care has been exercised in writing the item descriptions, including all applicable restrictions. In the event of any discrepancy, however, the restrictions on the gift certificate govern the item.
  8. Payment for items purchased must be made within 3 business days of the auction ending.
  9. Where possible, digital vouchers for items will be emailed to the winner after payment is made. Other items will be couriered following payment within the Greater Toronto Area. A nominal donation to assist us in covering the courier fee would be much appreciated. Pickup is not available. If the purchaser is out of the GTA, they will be responsible for the full shipping cost of any item. 
  10. For all alcohol lots, bidder must be of legal drinking age to bid and receive. Please drink responsibly.
  11. Michael Garron Hospital Foundation reserves the right to add or withdraw items, without notice, to or from the auction.
  12. Each person bidding assumes all risks and hazards related to the auction and items obtained at the auction.

Please note: Liquor purchased in the auction may not have been tested by the Liquor Control Board of Ontario (LCBO). Any alcohol auction purchases must be received upon delivery by an individual over the age of 19 who is not intoxicated. AGCO authorization number: AA1224377
